2. Intellectual AND INDUSTRIAL PROPERTY.

Industrial and intellectual property rights, including but not limited to: Brands, logos, texts, photographs, icons, images, etc., as well as graphic design, source code and other contained software elements on the WWW.MULTIOOPTICA.COM website, they are owned by MULTIÓPTICAS or by the companies that represent and manufacture the products offered. Therefore, they are subject to intellectual and industrial property rights protected by Spanish and international law.

Without prior written authorization from MULTIÓPTICAS or, where applicable, from the representative or manufacturer of the product holder of the rights, it is not permitted to use, reproduce, transmit, manipulate, as well as any use that exceeds a normal use and is necessary for the visit of the page and the use of the services offered.

4. Updating THE WEBSITE REFERED TO CONTRACTING.

Multiópticas reserves the right to make modifications and updates to products, prices, promotions and other conditions contained in WWW.MULTIOPTICA.COM.

Multiópticas, within its means, ensures that the information offered on the website is truthful and appears without typographical errors. If a typography error occurs, which is beyond our control, it will be corrected immediately. If you have made a purchase based on an error of this type, we will immediately inform you of this error, and both parties may cancel the purchase at no cost, provided that the existence of this error is justified.

5. Language AND DURATION OF CONTRACT. Minimum CONTRACTING Age

Regardless of the possible translations of the section of these General Terms and Conditions, the official language of the contract will always be the Spanish version.

As a contract term, we understand all the phases between the request for the initial order until the effective delivery of the goods by MULTIÓPTICAS and the total payment of the price agreed by it.

In accordance with article 1263 of the Civil Code, minors who are not emancipated and disabled persons cannot conclude remote purchase contracts without the express consent of their parents or guardians.

By accepting these General Terms and Conditions, you declare that you are of legal age (at least 18 years), have the legal capacity to acquire the products offered through WWW.MULTIPTICA.COM and that you understand the General Terms and Conditions in their entirety.

6. Legal GUARANTEE AND POST SALES SERVICE.

As a consumer, it has, apart from the rights described herein, all legal rights under Spanish and European law relating to the sale of consumer goods. We inform you that these legal rights cannot be seen as being affected by these "General Terms and Conditions of Contracting."

In the case of faulty products, we inform you that, according to current regulations, Multiópticas S Coop. must proceed, as appropriate, to repair, replace, reduce the price or terminate the contract, which will be free for you. Multiópticas S Coop. responds to the non-compliance faults that occur within THREE (3) years of delivery.

In this regard, it is understood that there is a lack of conformity when:

  • The product does not match the description made by the seller and does not possess the qualities presented by the seller to the consumer and user in the form of a sample.
  • The product is not suitable for uses to which products of the same type are usually intended.
  • The product is not suitable for any special use required by the consumer and user and has made it known to the seller, having admitted that the product is suitable for that particular use.
  • The product does not present the quality and usual benefits of a product of the same type as the consumer and user can reliably expect from the nature of the product and its characteristics reported in advertising and labelling.

Unless otherwise demonstrated, it will be presumed that the non-compliance faults that occur in the TWO (2) years after the delivery of the product already existed when the product was delivered. The consumer and end user must inform the seller of the lack of conformity as soon as possible from the time of detection. Failure to comply with this period will not result in the loss of the right to the corresponding restructuring, but the consumer is responsible for the damage or damages effectively caused by the delay in communication and due to the continued use of the good by the consumer once the lack of conformity has been detected.

7. Product DESCRIPTION DETAIL

Our commitment is to optimize the accuracy of any information regarding characteristics, qualities, images, etc. Of our articles published in this online store. If it is your first contact lens purchase, or if you have not reviewed your vision for more than one (1) year / graduation, we recommend that you ask your optician-opto-optic specialist or ophthalmologist for the diagnosis before you purchase it, as indicated by the General Council of Optometrists'Associations in its Manual of Good Professional Practices.

In order to be able to buy your contact lenses, you will have to provide us with the following information prescribed by your specialist:

Multiópticas is not responsible for any health damage that may be caused by the use of contact lenses, so you agree to buy contact lenses that have only been tested and adapted by a specialist.

The tolerance of the supplied product is the sole responsibility of the corresponding manufacturer. The manufacturer supplies the goods in the original package without opening. The correct application and handling of contact lenses is your responsibility exclusively.

The duration of use indicated for contact lenses refers to a period of time calculated according to the average use. To avoid eye problems, it is essential not to exceed the period of use indicated in the instructions on the box. If irritation appears, it is recommended that you stop using the contact lenses immediately and consult with your specialist.

Contact lenses subscription service: The contact lenses subscription service allows you to receive your contact lenses comfortably at home or to collect your lenses periodically quickly and easily. In any product with the active subscription option, select the “Subscription” option, choose the frequency with which you want to receive the product and usually complete the order. You have full control over your subscription at all times and we send you a reminder email 10 days before each transfer. You can change the delivery period, the date of the next transfer, change the amount of product to send, cancel your subscription by accessing my subscriptions in your account. Free contact lenses test: Multiópticas offers you the possibility of trying your contact lenses at home in comfort and free of charge (you will have to pay the shipping costs, you can view the shipping costs in section 13,1 Buy sunglasses, contact lenses and proof at home).

In order to carry out a free test of contact lenses, you must be a registered user of the website.

Free trial products are the Multilens Elite Silicone and Multilens Silicone 1 day daily contact models, both in sphere, torics and multifocal lenses and in monthly contact lens Multisilicone lens models in sphere, torics and multifocal, multilens silicone Relax sphere and multilens silicone Easy Fresh in sphere and torics.

In daily contact lens models (1 day = single-use contact lenses) you will receive one (1) five-lens box (5) eye lenses and monthly contact lens models will receive a blister with (1) contact lenses per maintenance (30 days).

To request the free test, you will be asked for a payment method (credit/debit card and Klarna) to cover the shipping costs. With the free test request, the system will generate a subscription to the selected product with the recommended frequency depending on the type of lens.

When requesting the free test of contact lenses, the user will receive two emails, one with confirmation of receipt of the free trial request and the other with confirmation of the subscription made.

This subscription will be made effective 15 days after the order for the free trial is placed. The first order for the subscription will be processed automatically 15 days after the test order has been placed. The user can cancel, modify or pause the subscription before these 15 days by accessing “my subscriptions” in their website user account.

9. Information FOR PURCHASE OF REEMPLAZO GAPS

Prescription glasses for replacement are limited to a product with the same exact technical specifications as prescribed for prescription glasses that you previously purchased as a result of the measurement and resulting prescription issued by your optician-opto-metythologist or ophthalmologist.

When placing your order on our website, confirm that prescription glasses have been prescribed in advance by your optician-opto-optic specialist or ophthalmologist, and that this adaptation has been well tolerated without exceptions.

If it is your first prescription glasses purchase, or if you have not seen it for more than one (1) year / graduation, we recommend that you ask your optician-opto-optic specialist or ophthalmologist for the diagnosis before you purchase it, as indicated by the General Council of Optometrists'Associations in its Manual of Good Professional Practices.

In order to buy your replacement glasses, you will have to provide us with the following information prescribed by your specialist, so that the lenses of your replacement glasses are identical to those prescribed:

  • Sphere

  • Axis
  • Addition

These details may be considered health data. By purchasing it, you give us the express consent to access and use this information to sell prescription replacement glasses. For more information, go to the Privacy Policy published on this website.

You will also need to give us information about the physical characteristics of prescription glasses for replacement:

  • Interpupillary distance
  • Nasopal distance

If we cannot guarantee that your prescription replacement glasses have the lenses identical to those prescribed by your specialist, we will contact you.

We will do everything we can to process the order requested from us at MULTIÓPTICAS. Even so, we reserve the right not to provide prescription replacement glasses because the specifications provided are not clinically appropriate. 

You will be responsible for the accuracy, veracity and accuracy of the graduation data you have requested from us for the purchase of prescription replacement glasses. If it does not fit your prescription glasses for replacement due to the specifications you have provided, MULTIÓPTICAS does not hold the responsibility.

Prescription sunglasses: In the case of sunglasses with a prescription, the lenses included are not polarised.

10. How TO BUY

10,1 Locate your products:

Locate the desired product in the corresponding section. In the product sheets, you can see the information regarding the product and its price:

  • In the case of sunglasses, you can select the desired colour.
  • For contact lenses, you will have to complete the fields corresponding to their graduation. If you need help and more information on the fields you need to fill in, click on “help” or click on the mouse on the concept you have doubts. Carefully read these instructions and make sure that the details of your graduation entered are correct.
  • For prescription glasses, you can choose the frame colour. All include single-phase organic anti-reflective lenses Multilens 1,5 AR, cylinder + 2, sphere + 2 a-4. You will have the option of adding additional treatments to your lenses with the price indicated on the product page.

10,3 Identify/Register:

You will have several options:

If you are a registered user, you will only have to log in with your username and password to continue with the purchase.

If you are not registered, you have three options:

  • Register by completing the fields we ask for. We recommend this because you can track your order at all times, you can get exclusive benefits and the following purchases will be much faster.
  • Buy as a guest. In this case, it will only complete the data necessary for processing and sending your order.
  • Log in with your Facebook or Google/Gmail username and password. Complete only the data needed to process and send your order.

If you buy prescription glasses, you will have to register, i.e. you will not be able to buy as a guest.

10,4 Complete your order:

  • Graduation (only in the case of purchase of prescription replacement glasses): You can choose between three options to give us your graduation:
    • Send it to us later: If you don't find your prescription or have any questions about how to complete your prescription, you can complete the order. We will contact you to help you complete it.
    • Appointment: If you do not yet have your graduation, you can also place the order. At the end of the order, we will give you direct access to request an appointment in your nearest MULTI-POLICY, and to be able to graduate for free. Our optician will send us your graduation.
    • Enter your graduation: If you have your prescription, complete the fields with the details of your graduation. Please note that you do not need to complete all fields; This will depend on your prescription (and therefore on the information you have from the specialist).
  • Delivery: You can choose between:
    • Send to a specific address: You will have to complete the details necessary to deliver your order, all the delivery address information and your contact details so that the messaging service can locate you.
    • Optical collection: You will have to select the store where you want to pick up your order and give us the contact details so that we can let you know when the order is available for picking or if any problem arises. Not available for Ceuta and Melilla.
  • Payment: You can pay with a credit card, PayPal or Klarna. You will have to select the payment method you prefer and fill in the corresponding information.
  • Complete purchase: Before completing your purchase, check all the information to make sure it is correct. Please confirm that you agree with these General Terms and Conditions by clicking on the corresponding box and finishing the purchase.
  • Invoicing: Multiopticas will send a simplified purchase invoice in paper format next to the order. 
    Similarly, if it is a registered user, in the “My Orders” section you can request that the invoice be provided in electronic format, and it is sent to the contact email address that the buyer registered in the purchase process. 
    Unregistered users who have made a purchase may request the invoice to be sent in the format they wish to send to the customer service department at their request. (Atencioncliente@multiopticas.com).

    11. Price AND PAYMENT METHODS.

    The website prices include VAT, but exclude shipping costs, which will be added to the total amount due. However, in orders over 50 euros, the shipping costs will not be charged.

    Prices may change at any time, but any possible changes will not affect orders with respect to those that we have already sent you an Order Confirmation.

    We accept the following payment methods: Credit and debit cards, PayPal and Klarna.

    • Payment via Visa, MasterCard and American Express Credit Card, which have developed a system to securely make payments on the Internet. The Secure E-Commerce system is based on the card issuer identifying the cardholder before authorizing payment via Internet. 
      The person responsible for any transaction with payment cards via this payment gateway is Multiópticas S Coop. by clicking on "Authorise Payment" you are confirming that the debit/credit card is your own.
      Credit cards will be subject to checks and authorisations by the issuing entity, but if the bank does not authorise the payment, MULTIOPTICAS will not formalize the purchase process or process the order made.
      Visa, MasterCard and American Express have developed a system to securely make payments on the Internet. If this is the means selected by the user for payment, a secure connection is established through SSL, where you must confirm the payment and enter the bank details directly. This page is not controlled by MULTIOPTICAS, but rather it is an external payment gateway, so MULTIOPTICAS does not have access to your bank details or stores them.
      When using the Virtual POS to make the payment by card, you are redirected to a page controlled by the Bank to make the payment through its payment gateway. For this reason, we inform you that the Bank's Virtual POS integrates the Secure E-Commerce (CES) feature in order to provide the purchasing process with high security and payment protection. 12. Transaction SECURITY.

WWW.MULTIOPTICAS.COM uses generally accepted information security techniques in the industry, such as firewalls, access control procedures and cryptographic mechanisms, all in order to avoid unauthorised access to data.

To achieve these purposes, you agree that the provider will obtain data for the purpose of the corresponding authentication of access controls.

Any contracting process that involves the introduction of personal data will always be transmitted through a secure communication protocol (HTTPS: /) in such a way that no third party has access to the information transmitted electronically. Likewise, to minimise the risk of unauthorised access, your credit card details will be codified.

If your order includes contact items such as contact lenses or solutions, it may take 1 to 2 days. If your order includes replacement glasses (graduate), it may take about 6 days.

 (*) In the case of consignments to Ceuta and Melilla, the User must also pay the customs and tax expenses generated by the order. These expenses are paid at the time the order is received and will not be included in the price paid for the products. If the order is not received for reasons attributable to the customer, the costs associated with the delivery and return of the order will be borne by the customer.

If the order is not received for reasons attributable to you, the costs associated with the delivery and return of the order will be borne by you.

No partial transfers are made.

Multiópticas undertakes to deliver the goods purchased by you, at the address indicated for this purpose in the order form. In the event of omission or error in completing this data, MULTIÓPTICAS is not responsible for the disadvantages caused and the resulting re-issuing costs will be borne by it. Under no circumstances will shipments be sent to postal and voice sections.

You can also choose “delivery in optics” as an order reception method. You can select the preferred delivery point in the purchase process from a list of MULTI-POLICIES stores associated with our online sales program.

Shipments will be sent only within Spanish territory, through a courier company. Multiópticas reserves the right to vary the type of delivery and the company for which it is carried out, regardless of what is set out on these pages, provided that it does not represent a clear injury to you.

The responsibility for the items is ours until the customer receives the delivery, except in the case that the customer expressly chooses a different form of delivery from the proposal by Multiópticas S Coop, in which case our responsibility would end at the time of collection of the shipment in our warehouse.

If force majeure reasons do not allow the delivery of the order within the established deadline, MULTIÓPTICAS undertakes to inform you as soon as possible of the new expected delivery date, and Multiópticas S Coop, in this case, is released from the commitment indicated in the previous section.

At the time of receipt, the User must check that the order matches the quantity and type of product with the requested one. If there is any discrepancy, the user must follow the indications in paragraphs 7. "Product DESCRIPTION DETAIL" and 14. "Refunds AND CANCELLATIONS" of these Terms and Conditions.

For the purposes of our General Terms and Conditions of Sale, it shall be understood that the "delivery" of the product has been carried out at the time of the one you or a third party indicated by you acquire the material possession of the products, which will be accredited by signing the receipt of the order at the agreed delivery address.

Multiópticas will inform you of the shipping costs. The acceptance of the "General Terms and Conditions of Contracting" will also entail the acceptance of the shipping costs.

For orders over 50 euros, no shipping costs will be charged.

Click & amp; collect: Collect your orders in your view.

The customer can pick up their order from most of our opticians. To do this, during the purchasing process, the User must select "Pick-up in optics." This will display a list of all our establishments available for this collection method. The customer must not pay transport costs in orders with in-store collection. A notification will be sent to you once the order has been delivered to the selected optician, so that it can be picked up. The customer will have a maximum period of 15 calendar days from the time their order is available to collect it.

If the order has not been collected by the customer for reasons not attributable to our Company after this period, the goods will be returned to our Central Office, and the customer must contact our customer service to request a new delivery. In this case, the customer may be charged the expenses of this new transfer.

14. Refunds AND CANCELLATIONS

14,1 Right of Withdrawal

If for any reason you are not satisfied with your order, we inform you that, in accordance with the current regulations on remote purchases, you have a period of fourteen (14) calendar days, counting from the date of delivery of the product, to return it. (According to Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Defense of Consumers and Users and other supplementary laws). art.68-79

Please note that the purchase of customised items (such as prescription glasses for replacement or glasses without prescription with blue stop filter), goods that can deteriorate or expire quickly, sealed goods that are not suitable for return for health or hygiene reasons and which have been unsealed after delivery and other circumstances provided for in the current regulations.

Remember that if you have benefited from a promotion at the time of purchase, you must return all the items covered by it.

In order for you to exercise your right to cancel the purchase, all returned products must be in perfect condition and protected with their initial packaging, or, failing that, in a package that offers the same or higher protection conditions for the product. Otherwise, Multiópticas S Coop. reserves the right to reject the return or to charge the customer the damages due to the faulty protection of the product during its delivery to our warehouse.

In any case, the customer will be responsible for the decrease in value of the returned goods resulting from a manipulation other than that necessary to establish the nature, characteristics and operation of these goods.

Please be informed that if you exercise your right of withdrawal, the costs of sending a refund will be borne by you. Multiópticas will reimburse the cost of the order and the shipping costs if any.

To exercise your right of withdrawal, you must notify MULTIÓPTICAS, by writing to the email address atencioncliente@multiopticas.com, of your decision to withdraw from the contract.

You can use the withdrawal form as an Annex to these General Terms and Conditions, although it is not mandatory to use it (link). To comply with the withdrawal period, it is sufficient for the communication relating to the exercise by you of this right to be sent before the corresponding period expires.

For refunds made from the mainland Spain or the Balearic Islands, the address to which you must send your returned products is: Multiópticas (Customer Service), Avenida de los Reyes S/N, 28770 Colmenar Viejo (Madrid).

For refunds made from the Canary Islands, the return address is: Multiópticas (Customer Service), Pol. IND. Monte Blanca, C/EL Mirador nº 17 (parcela 9), 35413 Arucas, (Las Palmas).

In the case of Ceuta and Melilla, send the products by the means of transport you choose, assuming the customs charges.

It is essential to include a copy of the document requesting the withdrawal, in the return package, together with the products, in which include the order number and updated contact details, so we can contact you once the return has arrived at our stores. The refund must be made within a maximum period of fourteen (14) calendar days from the date on which you inform us of your decision to withdraw from the contract. The period shall be deemed to have been met if the goods are returned before this period has ended.

Customers can make refunds on the online channel and in the optical establishments of the MULTI-POLICIES network.

If you wish to replace any item with another, the customer must return the item and make a new purchase (orders with customised products that cannot be returned are excluded)

14,2 Reimbursement
The repayment period is 14 calendar days from the communication of withdrawal, although this will not be carried out once the items have been received and it has been verified that the user has not carried out any manipulation other than that necessary to establish the nature, characteristics and operation of the items

Redemptions will be carried out using the same payment method in which the purchase was made and in the shortest possible time from the receipt and approval of the withdrawal request by Multiópticas S Coop.

14,3 Cancellation of Purchasing
The user can cancel the purchasing process provided that it has not been processed in its entirety. In order to ensure that the customer has cancelled the transaction, it is advisable to contact Multiópticas S Coop. by email at atencioncliente@multiopticas.com or by calling 91 835 73 02

15. On-site TEST SERVICE

Multiópticas offers you the possibility of trying your prescription replacement glasses free of charge, so that you can choose the frames that best suit you. There will be no purchase commitment if you don't like the frames that have been tested. Multiópticas reserves the right not to include all the frames in its catalog in this service.

To request proof at home, you will have to select at least three (3) frames, and you can choose a maximum of five (5) frames. This service is free. Before confirming your at-home test order, we will ask you for a credit card, but we can confirm that you will not be charged any fees. 16. Online gift CARD

17,2 Legal scope for the use of customer email addresses. 

You, by registering as such and purchasing our products, will receive promotions by email, as well as newsletters on news items.
